What is Proposition 65?

Proposition 65 “Prop 65” is a California law that applies to any company selling products in California.

The State of California’s Office of Environmental Health Hazard Assessment (“OEHHA”) maintains a list of over 800 natural and synthetic chemical constituents known to cause health risks. Prop 65 requires businesses selling products within the state to warn consumers if a product contains any listed chemical in any amount above very low levels.

Prop 65 is not a product safety law, it is a “safe harbor” law or a “right-to-know” law. The warnings are intended to help California consumers make informed decisions about their exposures to these chemicals from the products they use. These warnings are among the most stringent standards in world and are often far more stringent than federal standards.

Prop 65 warnings are seen throughout California in a wide range of settings -- in restaurants, grocery stores, hotels, schools, hospitals, and on a wide variety of consumer products. Aside from labeling product packages, the law requires internet and mail order retailers to provide Prop 65 warnings on their websites or in catalogs for all their products.
